Employer-sponsored pathways to permanent residency
An employer sponsored job can support several permanent residence routes, but each route has its own legal requirements. Compare 186 Direct Entry, 186 Temporary Residence Transition, an authorised labour agreement pathway, and the regional 494 to 191 route before treating a temporary offer as a permanent plan.

Key facts
| 186 Direct Entry | May be available without first holding a 482, usually with an eligible occupation, assessment and skilled work history. |
|---|---|
| 186 Temporary Residence Transition | Requires a fresh employer nomination and the qualifying temporary visa and sponsored work history. |
| 186 Labour Agreement | Depends on the employer’s agreement permitting a permanent nomination and the worker meeting its terms. |
| 494 to 191 | A separate regional provisional-to-permanent route; 191 is an independent visa application, rather than another employer nomination. |
| No automatic conversion | A temporary grant, period of service or employer promise does not guarantee permanent residence. |
Who this is relevant to
Temporary visa holders and their employers planning toward a permanent outcome.
Requirements
For a 186 plan, check the stream’s occupation, age, English, skills and work history as well as the employer’s genuine ongoing role and salary. For 191, check the eligible regional visa period, compliance and tax evidence. Home Affairs states there is no minimum income requirement for the Regional Provisional stream; required ATO assessment notices still matter.
Process
- Assess which permanent route is legally available on the current facts.
- Check work records, visa grants and the employer’s ability and willingness to nominate where required.
- Identify missing assessment, English or compliance evidence early.
- Recheck the route before lodging rather than relying on the settings when the temporary visa was granted.
Common issues
TRT does not mean every period of work on any temporary visa counts. The standard rules require eligible sponsored employment, with defined visa periods and exclusions. Regional permanent residence also requires a separate application; completing a period in a regional job is not sufficient by itself.
