Labour market testing, explained
Labour market testing (LMT) is employer evidence of efforts to recruit in Australia before an overseas worker is nominated. It commonly applies to 482 and 494 nominations; the applicable visa, stream and any exemption must be checked first.

Key facts
| General timing | Standard advertising must occur within four months before the nomination is lodged. |
|---|---|
| General evidence | The standard framework requires evidence of two advertisements and accepting applications for at least four weeks. |
| Advertising details | Approved advertising methods and required content matter, as well as duration. |
| Exceptions | Check a documented exemption or alternative arrangement; labour agreement requirements can differ. |
Who this is relevant to
Employers preparing a nomination who need to confirm whether testing applies to their situation.
Requirements
Confirm the rule before advertising. Check the position description, advertised terms and nomination details match, and retain the advertisements and recruitment evidence. International trade obligations may affect LMT. Do not assume that every employer visa uses the same advertising process.
Process
- Determine whether standard LMT, an alternative or an exemption applies.
- Schedule compliant advertising and accept applications for the required period.
- Retain evidence and lodge it with the nomination.
Common issues
Genuine recruitment can still fail the prescribed evidence requirements. A late advertisement, missing content or unsupported exemption can affect the nomination.
